# PromptGuard Terms of Service

These Terms of Service ("Terms") govern your use of PromptGuard, a mobile application provided by RiteUPAi ("we", "our", or "us"). By using PromptGuard, you agree to these Terms.

## 1. Acceptance of Terms

By downloading, installing, or using PromptGuard, you agree to be bound by these Terms. If you do not agree, do not use the app.

## 2. Description of Service

PromptGuard is a prompt security analysis tool that:

- Analyzes text prompts for potential security risks

- Detects sensitive information, injection attempts, and harmful patterns

- Provides sanitization suggestions

- Connects to AI providers for prompt execution (optional)

## 3. User Accounts & Subscriptions

### Free Tier

- Basic on-device prompt analysis

- Limited history retention

- One local AI server connection

### Pro Subscription

- Unlimited local AI server connections

- Cloud AI provider integration

- iCloud sync

- Export features

- App Lock

### Family Subscription

- All Pro features

- Sharing with up to 6 family members via Apple Family Sharing

### Billing

- Subscriptions are billed through your Apple ID

- Subscriptions auto-renew unless cancelled 24 hours before the renewal date

- Manage subscriptions in iOS Settings > Apple ID > Subscriptions

## 4. Acceptable Use

You agree NOT to:

- Use PromptGuard to create, distribute, or facilitate harmful content

- Attempt to reverse engineer, decompile, or extract source code

- Use the app to circumvent security measures of AI systems

- Violate the terms of service of connected AI providers

- Share your subscription access outside of Apple Family Sharing

## 5. AI Provider Connections

When connecting to third-party AI providers (OpenAI, Anthropic, local servers):

- You are responsible for complying with their terms of service

- You are responsible for any costs incurred with those providers

- We do not control or guarantee the availability of third-party services

- API keys are stored securely but at your own risk

## 6. Privacy

Your privacy is important to us. Please review our [Privacy Policy](PRIVACY_POLICY.md) for details on data collection and use.

Key points:

- Prompts are analyzed locally on your device

- We do not transmit your prompt content to our servers

- Analytics are anonymous and can be disabled

## 7. Intellectual Property

### Our Rights

PromptGuard, including its design, features, and code, is owned by RiteUPAi and protected by intellectual property laws.

### Your Rights

You retain all rights to your prompts and content. We do not claim ownership of any text you analyze.

## 8. Disclaimer of Warranties

PromptGuard is provided "AS IS" without warranties of any kind.

We do not warrant that:

- The app will be error-free or uninterrupted

- Security analysis will catch all threats

- Sanitization will remove all sensitive information

- The app will be compatible with all devices or AI providers

PromptGuard is a security tool, not a guarantee. Always review prompts manually before sending to AI systems with sensitive data.

## 9. Limitation of Liability

To the maximum extent permitted by law:

- We are not liable for any indirect, incidental, or consequential damages

- Our total liability is limited to the amount you paid for the app in the past 12 months

- We are not responsible for any data loss, security breaches, or harm resulting from your use of the app

## 10. Indemnification

You agree to indemnify and hold harmless RiteUPAi from any claims, damages, or expenses arising from:

- Your use of PromptGuard

- Your violation of these Terms

- Your violation of third-party rights or terms of service

## 11. Termination

### By You

You may stop using PromptGuard at any time by deleting the app. To delete your data, use Settings > Account > Delete Account before uninstalling.

### By Us

We may terminate or suspend your access if you violate these Terms. Upon termination:

- Your subscription will not be refunded (prorated refunds at Apple's discretion)

- You must cease using the app

- Your local data remains on your device until you delete it

## 12. Changes to Terms

We may modify these Terms at any time. Continued use after changes constitutes acceptance. For significant changes, we will notify you through the app.

## 13. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

## 14. Dispute Resolution

Any disputes will be resolved through binding arbitration in accordance with the AAA Commercial Arbitration Rules, except that you may bring claims in small claims court.

Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions.

## 15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

## 16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and RiteUPAi regarding PromptGuard.
